The Sydney Opera House and Samsung Electronics Australia have announced a photographic competition that will display images from members of the public on the Opera House sails.
For ten days from today (12 April), people will be able to submit their images of life in Australia for consideration by a selection panel. On April 23, 2013, coinciding with the launch of Samsung’s GALAXY S 4 smart-phone, the Opera House sails will be transformed into a portrait of this country and its people. The display is part of a three-year, multi-million dollar partnership between the two organisations and Samsung will be the Opera House’s first Principal Partner. FOOTNOTE: One of our readers has alerted us to some of the Terms and Conditions of this competition that should be brought to the attention of potential entrants. These terms, he writes, are unacceptable to professional photographers. He draws specific attention to the following:
11. Each Participant warrants to the Promoter and the Sydney Opera House Trust that the Photo Entry is an original artistic work of the entrant that does not infringe the rights, including intellectual property or privacy rights, of any third parties. The Participant agrees to indemnify the Promoter and the Sydney Opera House Trust against all claims and costs by third parties arising from a breach of warranty set out in these Terms and Conditions
12. All Participants, including Finalists, hereby provide a non-exclusive, royalty free, irrevocable, perpetual, transferable, worldwide licence to the Promoter and the Sydney Opera House Trust to use the Photo Entry for any purpose, including, without limitation, for advertising the Promoter’s products and publishing on any of the Promoter’s websites or any social media site at any time and for any reason. The Participant hereby waives all moral rights they have in the Photo Entry submitted to the fullest extent permitted by law.
